Conditions of Use

 §1) Orders

All orders are only accepted under our general terms and conditions of delivery and payment. Our offers are non-binding. We do not guarantee that the goods offered for sale by us will actually be available and at the stated prices.

§2) Delivery

 

Delivery times are only binding if they have been confirmed by us in writing. The delivery takes place from Großostheim. In all cases, the buyer bears the shipping costs unless the limit for the free shipping amount has been exceeded. Our prices include packaging that is customary in the trade and suitable for normal shipping. International shipments can only be made against prepayment.
If the order is accepted, the goods will be sent immediately after receipt of payment. Payment is received on the following account:

§3) Right of Withdrawal

You can revoke your contract declaration within 14 days without giving reasons in text form (e.g. letter, e-mail) or, if the item is left to you before the deadline, by returning the item. The period begins upon receipt of this information in text form. The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline. The revocation must be sent to:

Consequences of Cancellation

In the case of an effective cancellation, the mutually received benefits
to return and, if necessary, to surrender any benefits (e.g. interest). If you are unable or partially unable to return or surrender the received service and benefits (e.g. advantages of use) or only in a deteriorated condition, you must compensate us for the value. For the deterioration of the item, you only have to pay compensation if the deterioration is due to a handling of the item that was beyond
the examination of the properties and the functionality goes beyond. Under "Examination of the
Characteristics and functionality "means testing and trying out the respective goods, as is possible and customary in a shop.
Transportable items are to be returned at our risk. You have to bear the regular costs of returning the goods if the goods delivered correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of 40 euros or if you have not yet received the consideration or a have made the contractually agreed partial payment. Otherwise, the return is free of charge. Items that cannot be sent as a parcel will be picked up from you. Obligations to reimburse payments must be fulfilled within 30 days. The period begins for you when you send your declaration of cancellation or the goods, for us with their receipt.

§4) Prices

All prices quoted are final consumer gross prices and include the German 19% VAT.

§5) Payment

If you would like to pay the invoice amount in advance, the shipment will take place after the invoice amount has been received on our bank account.

§6) Retention of Title

All goods remain our property until the purchase price including interest and other expenses has been paid or as long as we still have claims against the buyer.
The place of jurisdiction is Aschaffenburg.

§7) Miscellaneous

We would like to point out that we store and process personal data of our customers arising in the course of normal business transactions in accordance with the Data Protection Act.

§8) Intellectual Property Rights

The intellectual property rights for the Nostalgiefilm Internet pages, including their design and content, in particular all documents, elements and programs, belong exclusively to Nostalgiefilm and may not be reproduced, distributed, edited or publicly reproduced without prior express consent. Exceptions apply to the parts of our online offer that have been made available to us by other companies.

The reproduction or other use of the published documents is only permitted for informational purposes or for personal use. Any other reproduction or any other use is expressly prohibited.

§9) Important Customer Information

They may be slightly different from the original products in color, shape and size. We reserve the right to make changes, misprints and errors of any kind. The contract is subject to German law. The ineffectiveness of individual points of these general terms and conditions does not affect the effectiveness of the remaining provisions.
